Many of the debtors that we deal with ask the same question, can debt collection agencies take you to court in the UK? The simple answer is yes, they can. Many Debt collection agencies work on behalf of the original creditor and may or may not be authorised and regulated by the FCA.
Debt collectors are usually passed the debt information and begin trying to contact you. At this stage it is wise to contact the debt collection agency and tell them what you can afford to pay on a weekly or monthly basis, this will usually pause any pending court action.
Both the original creditor and the debt collection agency will most likely be happy that you are paying the debts and leave it at that. If you do default on a payment plan then you may receive a default notice, you should try to rectify the situation as soon as possible.
If you do not pay the debt then the debt collection agency may ask the original creditor if they wish to take court action against you, if they do then you will receive the court paperwork. You are now at risk of receiving a county court judgement, which may lead to enforcement agents attending your house. Enforcement agents are different to doorstep collectors, they can sell your goods at auction if you don’t pay your debts.
Ultimately a debt collection agency can take you to court in the UK if their client wishes, you should seek immediate advice and pay the debt if you can
